简易小白反S386指南

Q: 我们为什么要反对S.386?

A: 因为S.386严重不利于美国、美国华人。这个法案将会:

  • 让未来10-15年时间段内,华人技术移民极大减少,其中5-6年完全绝迹。
    • 失去“源头活水”,华人在北美政坛将更加弱小,更容易被孤立、欺凌。
  • 鼓励外包公司(ICC)进一步搬运廉价劳工挤占正式岗位,华人即使有绿卡、国籍也会被排挤、layoff。
  • 非印出生的世界各国人士都会受到严重负面影响。无法看到留美工作的希望,留学生们将不再把美国大学作为他们的第一选择。降低美国大学科研及国际竞争力,进而降低其学位含金量。
  • 孩子毕业后去技术公司发展,也会受到类似的挤压效果,导致华人全方位面临挤压。
  • 未来10年间绿卡被IT行业印度出生的移民垄断,非IT行业将会面临严重的技工短缺,影响区域经济发展、科技创新、生活质量。
  • 法案号称解决backlog,但预计通过后backlog增加量会是消化量的两倍,导致全世界排期不断延长,引发合法移民系统的彻底崩溃,即使现在有利的绿卡类别也可能陪葬。

三年“缓冲期”结束后,EB2/3移民排期很可能延长3-7年,且难以准确预测。不能否认386法案对目前正在排期的EB5移民有利,但我们不应该以牺牲EB1/2/3和未来EB5的移民排期为代价,我们不应当放弃任何一个华人合法移民的美国梦,更不应当让任何一个华人合法移民群体,在政治斗争中被牺牲。

Q: 为什么我们应该马上行动?

A: 通过一个法案只需要51票,打破个别参议员的filibuster只需要60票。现在,S.386法案在参议院中公开明确的支持者(cosponsor)已经达到34人,局势已经十分危急,很多说法主张“不用担心不会通过”,我们认为这样想太过乐观了。

Q: 我们能够做什么?

A: 大部分美国公众,甚至很多议员,只听到了支持者一边的声音,并不了解这个法案的细节,更不了解它目前版本的诸多弊端和问题。我们应该让更多美国议员、公众了解到这个法案的弊端。

只要人在美国境内,无论给议员写信、打电话,还是面见议员,或者在媒体上发表文章说服公众,受到美国宪法第一修正案的保护,不是“干涉美国内政”,没有法律风险

A.见议员

C. 给议员打电话

按照上面方法找到没有cosponsor的议员的电话,把你写的信的conclusion部分念一遍。如果没时间,说一句你反对S386即可。再次重申,很多议员办公室就是数数的,虽然陈述理由是最好的,但如果实在对自己的英语没信心或者没有时间,打个电话表达一下自己的态度也比没有打要好。

我们的口号是:每一个反S.386的朋友,请尽量给您所长期居住、较为熟悉的所有州每位参议员,写一封信&打一个电话。

有些参议员office就是数yes和no的留言数来决定投票的,很草率,但是真的……

给参议员写信,很简单,一点都不复杂。只要做以下几件事:

如何给议员打电话

1.在这里找到参议员DC office的电话号码:https://www.senate.gov/senators/contact

2.让他们反对S.386,只需要念清楚法案名字,并清晰表达No的观点就可以了,不要说太多

Sample:

Hello, my name is (name). I am a resident of Senator (name) from (hometown). I am calling to urge Senator (name) to vote against S.386 — Fairness for High-Skilled Immigrants Act of 2019. Because it will kill diversity (如果你的议员是民主党)/ will encourage outsourcing companies to take away more American jobs (如果你的议员是共和党). It also hurts universities in the US because it favors outsourcing workers over the graduates. Please vote against this bill, thank you.

这样就行了,不需要说更多了。

为什么要打电话?有的人说打电话给议员是垃圾轰炸,这种想法是错误的。一方面,议员需要电话数据来统计民意(包括非选民的民意,因为非选民背后也有美国利益相关者,有利益就有选票)。另一方面,有的议员本来就打算反对,他们就等着一些信件、电话、约谈数据,才能正大光明地反对。我们是给他们送炮弹的。

以上这两种情况,都是议员办公室的staff亲口对我们说的,不是我们的臆测。

所以,给议员打电话,重点就是告诉他们yes或者no。至于理由、论证可以参考以下:

When talking to staffers for Republican Senators, these are the talking points I stick to based on guidance I’ve received from the Center for Immigration Studies:

  1. Bill H.R. 1044/S. 386 moves away from a “Merit” based immigration plan.
  2. Bill H.R. 1044/S. 386 against President Trump’s Buy American Hire American Executive Order because it incentivizes more H-1B abuse.
  3. Bill H.R. 1044/S. 386 rewards Senator Kamala Harris of California (Democrat) with a win.
  4. DHS/USCIS does NOT support Bill H.R. 1044/S. 386.
  5. Bill H.R. 1044/S. 386 suppresses employer’s access to a global pool of high-skilled talent by rewarding the low-skilled contract workers who came under the dysfunctional system.
  6. Bill H.R. 1044/S. 386 will create a train wreck in our legal immigration system as we have on the border, by creating an even bigger backlog for every country’s nationals, thereby forcing Congress to INCREASE green card numbers.

For the staffers for Democratic Senators:

  1. Bill H.R. 1044/S. 386 will end diversity in our immigration system, allowing one country to monopolize all employment-based green cards for the next decade.
  2. DREAMERS (DACA) will also be affected by Bill H.R. 1044/S. 386 as some want to get legalized, and obtain employment-based green cards is one pathway for them to do so. Same for folks on TPS (Temporary Protected Status).
  3. Bill H.R. 1044/S. 386 pits immigrant groups against each other in a zero-sum game of who’s worthy to be here.
  4. Bill H.R. 1044/S. 386 would favor only one industry (Big Tech) for receiving employment-based green cards, while other industries (Healthcare, Entertainment, Food Services, etc.) would never see the light of day of having their employees obtaining green cards.

For both groups:

Bill H.R. 1044/S. 386 does not address the source of the backlog problem, but rather the symptoms. You can remove country caps, increase the number of green cards, or both; but until the source of the problem is not addressed, the backlog will continue to remain.

The source of the problem is H-1B abuse, where a business model has developed whereby Indian Contracting Companies like Tata, Infosys, Cognizant, etc. have monopolized the H-1B visa program to in-source cheaper labor primarily from India. Because of the dual-intent nature of the H-1B, these in-sourcing companies can entice cheaper foreign workers to come in and work for cheaper salaries, in hopes to receive sponsorship for employment-based green cards in return.

Until the H-1B visa program is not reformed, simply fixing the green card program on its own is NOT going to amount to anything. We need a comprehensive fix for BOTH visa programs and have to incorporate a merit based system that rewards truly high skilled immigrants, and one that protects American workers from job displacement and wage stagnation.


不要种族歧视!

无论议员属于哪个党派,都不要种族歧视。尽量避免Indians blabla…的陈述,我们的批判对象是outsourcing,不是Indian people。

无论你是什么签证,只要合法居住在美国,都有权利给议员写信、打电话。

H/L签证说什么都可以,F等非移民签证不要表达出自己有移民倾向就可以了。

美国境内任何人的政治言论自由都受宪法第一修正案保护,只要不参加与竞选集资相关的活动,就没有法律风险。谁跟你说这个违法、要去FBI告你之类的,说明他需要我们的科普。对他笑一笑吧😁

我们是紧急集结的草根团队,不过十几个人,日以继夜守望在法案闯关的最前线。我们打算在全美各州组织面见参议员,但现在大部分州还一个人都没有找到,给议员写信、打电话这方面,也面临着利益集团正规军的强大压力,Twitter等社交媒体上更是被铺天盖地的对方水军淹没。眼下每个组员都是超负荷运转。

What is ICC (IT Consulting Company)?

IT Consulting Company, also referred to as IT Service Providers, are usually labelled as multinational corporations, specializing in providing certain types of services to business with overseas workforce. Different ICCs provide different areas of expertise. Sometimes the work is done remotely offsite, but in most cases, international workforce are placed onsite at clients offices.

How does ICC bring over international workforces?

  • Step 1: Get hired by ICCs.
  • Step 2: Go through bootcamp. Technical skill trainings, interview skill trainings, “polish resume” trainings are provided. Very specific skills are taught like how to answer questions as someone you are pretending to be (with the polished resume).
  • Step 3: Interview with clients with skills learned from bootcamp.
  • Step 4: Receive contracting offer(s). Offer amount are normally split between ICC and employees. (70%, 30% in this case)
  • Step 5: Apply for H1b(s). Depend on how many offers one receive. There were people who filed 5 applications at once. And in most cases, 2 applications is the bare minimum as majority of them are bachelors. They need to increase their chances of getting selected from the regular cap. 
  • Step 6: Maintain legal status in the US by enrolling in US schools specializes in providing curricular training credits for work authorization while filing for H1b petitions.
    • International American University
    • International Technological University
    • Sophia University
  • Step 7: Extend US status if not selected by 1. Finishing a degree and use OPT. 2. If OPT not applicable, start another degree and apply for CPT.

Here are the facts you need to know about HR1044/S386… and HOW TO STOP IT!

What is it?

The HR1044/S386 is a bill on immigration/green card that recently passed the House. It plans to lift the per-country limit on green cards. 

As a result, the backlog of some countries (namely, India) will flood into everyone else’s pool, and all new green card applicants on EB2/3 need to wait 6+ years, until the backlog disappears.

Background

If a foreigner doesn’t have a family here, the primary way to get a green card is through employment (EB2 or EB3). They prove they have a skill that a US company needs, get a work visa (H-1b), and after some years they can apply for a green card and wait in the queue.

There has been a lot of H-1b abuse in the past years. Many puppet IT consulting companies did H-1b fraud by claiming that they “hired” some foreigners, so that they could obtain a work visa and file green card applications. Those people are the main source of current green card backlogs.

What consequences will it bring?

For the next 6+ years, in the professional/skilled category, only people in the backlog can ever get a new green card. Those people are primarily from the same country (Indian) and in the same industry (IT tech consultants). This means:

  • Other industries will not be able to find any foreign skilled workers. For example, some states will see a shortage of nurses.
    • Senator Rand Paul has an amendment bill for this.
  • People of all races will be discouraged to come to the US if they know their wait will increase by at least 6 years.
    • America is partly built on talents from all over the world, because they are attracted by this “American Dream”.
    • Universities, for one, will lose a lot of talents who are currently pursuing high degree and will definitely miss the 3-year transition period.
  • H-1b abuse will happen more often than ever, because this bill fixes nothing of it.
    • Many of the abusers currently in queue doesn’t even have a US college degree and have never received US education.

How to stop it

The bill has already passed the House, and will proceed to the Senate. Possible ways to help:

  • Contact the local senators through emails and talks;
  • Contact the media;
  • Spread the news to other immigrants and concerned groups, so that more people can join.
